Settlement

In Pennsylvania, there is no absolute right to a lump-sum settlement in a workers’ compensation case. All the insurance carrier is required to do under the law is pay 2/3 of an injured worker’s lost wages and pay for all reasonable and necessary medical treatment related to the work injury. They are not legally obligated to pay you a lump sum.

That being said, the majority of workers’ compensation cases are resolved by a lump-sum settlement paid to the injured worker. This happens when both sides agree that a settlement is in their best interest.

You may be eligible to a lump-sum settlement for your work injury. If you have been receiving workers’ compensation benefits for an extended period of time, you have reached maximum medical improvement and you are unable to return to your time-of-injury job because of your permanent restrictions, your case may be ripe for settlement.
